Terms of Use

To provide better services for you, before you start to use LOCATER Mobile Applications, software products and related services, please read carefully and fully understand the terms of the LOCATER Terms of Service (hereinafter referred to as the “Terms”), especially the terms of exemption or limitation of liability, applicable law, and dispute resolution. Terms of exemption or limitation of liability and other terms involving your vital rights and interests may be uppercase or underlined to remind you to pay attention. If you are a minor under the laws of the jurisdiction in which you reside, please read carefully and fully understand this terms accompanied by your legal guardian, and use the LOCATER Services after obtaining the consent of the legal guardian.

Please do not use the LOCATER Services unless you have fully read, fully understood and accepted all of the Terms. By filling in the information as prompted on the registration page, reading and agreeing to this Terms and completing the entire registration process, you have fully read, understood and accepted these terms and agree to be bound by this agreement and other agreements and rules related to the LOCATER Servcies (including but not limited to the LCOATER Privacy Policy) as a party to this Terms, becoming a user of LOCATER.

If you have not applied for the registration process, or have been a registered user of the Platform prior to the effective date of this Terms, by accessing and/or using our LOCATER Services, you are deemed to agree to be bound by these terms.

LOCATER reserves the right, at its sole discretion, to arrange or designate its affiliates, controlled companies, successor companies or third-party companies approved by LOCATER to provide the services to you as required by LOCATER. You acknowledge and agree that by receiving the services, you accept that the rights and obligations of such parties are also governed by this Terms.

The headings of each term are intended to assist you in understanding the subject matter of the terms and do not affect or limit the meaning or interpretation of the Terms. In order to protect your rights and interests, you are advised to read the specific expressions of each term carefully.

If you do not agree with the content of this Terms, LOCATER will not be able to provide you with the full service, and you may return the products and services through the prompts in the Return and Exchange Policy.

1. Scope

1.1 Contracting parties

This Terms shall be legally binding on both you and our Platform Operator.

Under this Terms, our Platform Operator may be changed according to the business adjustment of the Platform, and the changed Platform Operator will comply with this Terms and provide services to you, and your rights and interests under this Terms shall be guaranteed. New Platform Operator may be added for the provision of new services on the Platform, and if you use the new services on the Platform, you shall be deemed to agree that the new Platform Operator shall jointly perform this Terms with you.

In case of dispute, you may determine the subject of performance and the other party of dispute according to the specific service you use and the specific behavior object that affects your rights and interests.

On a global basis, our Platform applies to the areas where use is permitted by laws and regulations, and it is your responsibility to ensure that LOCATER Products and Services are available legally in your area.

1.2 Supplementary Agreement

Due to the rapid development of the Internet industry, the conditions set forth in this Terms concluded by you and us cannot fully enumerate and cover all rights and obligations of you and us, and the existing agreements cannot guarantee full compliance with the needs of future development. Therefore, unless otherwise stated, the relevant statements, policies, rules and agreements released on the Platform are all supplementary to this Terms, which are inseparable from this Terms and have the same legal effect. If you use our LOCATER Services, you are deemed to agree to the aforesaid supplementary agreements.

The Platform system may be upgraded occasionally and various new features may be added, including but not limited to the user registration feature and the associated video and picture storage features under the registration account, etc. Your continued use of our LOCATER Services is deemed to be your knowledge of our Platform system upgrades and changes and your agreement to abide by the latest rules of our Platform.

2. Obligations and Behavioral Rules

In order to use the services of LOCATER to the full extent, the user must use current technologies or enable their use an up-to-date LOCATER Mobile Application. When using older technologies, outdated apps or outdated devices, the user may not be able to use our LOCATER Services completely or not at all. LOCATER will ensure that all services of the LOCATER Mobile Application can be used with the latest two major version updates for Android and iOS.

The user must treat the access data / credentials (the combination of email address and password) as strictly confidential and protect them from unauthorized access by third parties. The password must not be shared with anyone, including employees of LOCATER. If the user has reason to believe that the credentials have been compromised in any way, the user is obliged to change the respective password immediately.

The user must use the services provided by LOCATER as intended and refrain from actions which harm or endanger LOCATER, other LOCATER users or may third parties and / or the avaliability of the services for other users. Proper use also includes compliance with all instructions, recommendations and the like that LOCATER carries out at the time the subscription plan is activated or anytime thereafter on its homepage, in operating instructions and / or other documents make available to the user. The LOCATER GPS Tracker is designed specifically for animals, persons and object tracking and should therefore only be used for this purpose. In some countries and regions, there are laws on location tracking of animals, persons and objects. Only the customer or user of the LOCATER GPS Tracking Device, but not LOCATER, is responsible for complying with such laws or regulations.

LOCATER provides users with the ability to post content in databases, communicate and interact with other users. The user warrants not to misuse the services of LOCATER. The user uset comply with the following rules in particular:

The entry of any personal data in the public profile of the user is at the user’s own risk.
The publication of data of third parties (e.g. The creation of a profile for a third party) without the third party’s consent or the uploading of an image which shows a third person without his consent is also inadmissible.
The user is solely responsible for the content stored in his profile. The user agrees to comply with all relevant statutory provisions when posting content in his profile. In particular, they must not distribute any content, material, information and/or pictures that are immoral, pornographic, obscene, racist, glorify or trivialize violence, distrbute radical riight-wing or left-wing ideas or that are identified as offensive or unlawful in any other way.
The user also undertakes not to threaten or harass third parties or other users and / or violate their rights.
The use of LOCATER Services for commercial purposes if prohibited.

3. Software Upadates

In connection with providing the LOCATER Services, we may update the software of the LOCATER Mobile Applications or LOCATER Device at any time. These updates may include bug fixes, feature enhancements or improvements, or entirely new versions of software. You agree that we may automatically deliver such updates to you as part of the LOCATER Service and you shall receive and install them as required, and you acknowledge and agree that the LOCATER Servcies, or portions thereof, may not properly operate should you fail to do so. You further agree that all updates will be deemed part of the LOCATER Services and will be subject to this Terms.

4. Third Party Software

The LOCATER Services may contain or otherwise incorporate the use of portions of software being the sole property of third parties. Any such software is provided subject to the terms and conditions of such third party. Third party software used in connection with the LOCATER Services may include.

You agree and understand that by using the LOCATER Services, you agree to be bound by Google’s terms of use available at https://developers.google.com/maps/terms and Google’s privacy policy, as amended by Google from time to time, currently available at http://www.google.com/privacy.html.

5. Availability, Warranty, Liability

5.1 Warranty

Except for the rights granted to consumers under mandatory law, any product or service made available is provided on an “as is” and “as available” basis. Within the limits of mandatory laws, LOCATER warrants only that products will be provided to you in usable condition. If your products are damaged or of unacceptable quantity or quality, LOCATER’s sole obligation, and your sole and exclusive remedy, will be for LOCATER, at its sole option, to either refund the full amount of the purchase price of such products, or exchange the products at no extra cost. Except for the above express limited warranty, to the extent permitted under applicable law, LOCATER and its affiliates expressly disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantiability, satisfactory quality, fitness for a particular purpose, and non-infringement and warranties for any third party servcies or products.

5.2 Limitation of Liability

Except for damages for bodily injury, death, damage to real or tangible personal property, intentional misconduct or gross negligence, or any other liability that may not be limited under applicatble law, in no event will be liable for any loss or unavailablility of or damage to data, lost revenue, lost profits, failure to realize expected savings, damage to reputation, business interruption, downtime costs or any indirect, incidental, consequential, special, punitive, exemplay or any similar type of damages arising out of or in any way related to the agreement, the use or the inability to use the services or product, or third party products or services, even if advised of the possibility of such damages.

5.3 Indemnifies

The user indemnifies LOCATER from all claims that third parties make against LOCATER for any violation of their rights by content posted by the user within the LOCATER network or through any other use of available applications on LOCATER’s network. The user assumes the costs of a necessary or appropriate legal defense of LOCATER including all court and legal fees as prescribed by law. This does not apply if the infringement is not attributable to the behavior of the user.

6. No Professional Advice

If the LOCATER Services provides professional information, such information is for informational purposes only and should not be construed as professional advice. No action should be taken based upon any information contained in the LOCATER Servcies. You should seek independent professional advice from a person who is licensed and/or qualified in the applicable area.

7. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of UK.
